Right To Rent
To rent a property in England you must be able to show proof of your right to rent.
British and Irish Citizens
If you are a British or Irish citizen you have unlimited right to rent in the UK. You can provide a current or expired passport to prove your right to rent. If you do not hold a passport you can provider a valid UK driving licence & a UK birth certificate.
You can prove you have the Right to rent through a share code. You use a share code to prove you have the Right to rent through the Government.
The Government website is www.gov.co.uk/prove-right-to-rent you go on the site and you can share your details of your Right to rent in England including how long you can rent for.
You can use the service is you have;
- A biometric residence card or permit.
- Settled or pre-settle status
- You have applied for a visa and used UK immigration; ID check app to scan your identify document on your phone.
If you do not have these documents the Government website we have linked above provides you with other documents you can use.
In order to prove your Right to rent online you will need your date of birth, biometric residence permit, biometric card, passport or nationality ID card.
You then use through the click through site of the Government and they will then provide you with a share code. We would need this as Harringtons Lettings including your date of birth in order to use the share code to show you have the Right to rent.
Landlords/letting agents have to use the Government website to check the tenants right to rent in England. This can be done by landlord, agent or tenant subletting with the landlords permission.
The tenant needs to provide this and it can be used if the tenant has a biometric resident card or permit, has settled or pre-settled status and has applied for a visa.
We then go onto the site, use the tenants date of birth and the share code.
You can apply to the EU settlement scheme for settled or pre-settled status.
These could be either;
- Settled status.
Usually where you have lived in the UK for continuous 5 years.
- Pre-settled status.
You will not be asked to choose which one you are applying for. Which status you get usually depends on how long you have been living in the United Kingdom.
You may be able to offer settle status before you have 5 year continuous residence.
There are various ways this is worked out by the Government and you should read through their website in this regard.
From the 1st October 2022 we have to ensure that you have the Right to rent by obtaining the following;
- Copies of your documents.
- Using an online right to rent checking service
- Contacting digital identify provider.
Who has the right to rent?
You have the right to rent if you are any of the following;
- British or Irish citizen
- You have an indefinite leave to remain
- You have a refugee status or humanitarian protection
- Having settled or pre-settled status under EU settlement scheme
- You have permission to be in the UK for example on work or student visa
- The home office has granted you a limited time to right to rent
- If you have fled in the Ukraine War
- If you are an asylum seeker. You do not normally have the right to rent but you get housing through the asylum seeker support system.
There are various documents you may need to provide us with in order to carry out this right to rent.
EU Citizens
If you are from the EU, Switzerland, Norway, Iceland or Liechtenstein you must provide a share code of your settlement status from the government’s website in order to prove your right to rent.
If you have settled or pre-settled status or applied for a visa and used the ‘UK Immigration: ID Check’ app to scan your identity document on your phone, please visit https://www.gov.uk/ to obtain your share code
You will need:
- details of the identity document you used when you applied (your passport, national identity card, or biometric residence card or permit)
- your date of birth
- access to the mobile number or email address you used when you applied – you’ll be sent a code for logging in
Then follow the below steps to obtain your share code:
- In the search bar type in ‘right to rent’
- Select ‘View and prove your immigration status’ (eleventh option down)
- Start now
Non EU Citizens
You must provide a share code from the government’s website in order to prove your right to rent. We cannot accept physical copies of biometric immigration documents (current or expired) issued by the Home Office. This includes Biometric Residence Permits (BRPs) and Biometric Residence Cards (BRCs).
Please visit https://www.gov.uk/ to obtain your share code. You will need your date of birth and details of one of the following:
- your biometric residence permit
- your biometric residence card
- your passport or national identity card
Then follow the below steps to obtain your share code:
- In the search bar type in ‘right to rent’
- Select ‘Prove your right to rent in England’ (third option down)
- Start now
- Answer the questions that relate to your immigration status
